Assisted reproductive technology (ART) includes sperm donation, egg donation and embryo donation, as well as surrogacy and gestational carrier arrangements.
The emerging field of ART law finds its roots in adoption law and thus was a natural extension of Copps DiPaola Silverman, PLLC’s family formation practice. Our attorneys have been involved in ART law since its inception and were heavily involved in the efforts to enact the Child Parent Security Act (“CPSA”) in New York, which created a paradigm shift in New York from parentage by biology to parentage by intention.
Our attorneys remain committed to legislative efforts to improve laws in the ART field and remove barriers to this form of family building. Attorneys Casey Copps DiPaola and Joseph Williams are both Fellows of the Academy of Adoption & Assisted Reproduction Attorneys (“AAAA”) where Casey is a long-time member of the legislative committee. Casey and Joe are also heavily involved with New York Attorneys for Adoption and Family Formation (“NYAAFF”), where Casey is the President and Joe is a Director and Co-Chair of the Legislative Committee. Casey also participates in RESOLVE’s annual Advocacy Day.
After the CPSA became law, Casey and Joe were frequent lecturers to various groups in the fertility industry and legal community, including presentations for more than 10 fertility clinics, local and state attorney bar associations, court staff, judges and law students.
Casey and Joe also founded New York Surrogacy Center, the first surrogacy matching program licensed by the New York State Department of Health after the CPSA legalized compensated surrogacy in New York. Running a surrogacy agency gives us in depth knowledge of every step of the surrogacy process and allow us to provide superior guidance to our clients, and particularly those navigating an independent surrogacy journey without the assistance of a surrogacy agency.
Our firm has attorneys licensed in New York, New Jersey, Vermont, and Pennsylvania and can assist clients in any of these states with their ART law cases.
