Domestic violence is a pattern of coercive behavior perpetuated by an intimate partner against their partner with the purpose of establishing and maintaining power and control.
Allegations of domestic violence or abuse can be seen at the forefront of many divorce and child custody cases. Domestic violence comes in many forms. While bruises and black eyes permeate our television screens, we know that the scars from repeated emotional and verbal abuse have a lasting impact on the recipients of the abuse, and that children who are present to hear and/or see domestic violence are also negatively impacted. The most dangerous time for victims is when they try to leave an abusive relationship. The safety of our clients is a top priority and, therefore, we safety plan with our clients to ensure that they are safe and that the legal action we take on their behalf will not put them in further danger.
If you, or someone you know, is a victim of domestic violence, options are available. One option is requesting that a civil Order of Protection be issued against the abuser. In New York, various provisions can be included in Orders of Protection. For example, an abuser can be directed to:
– Stay away from and have no contact with the victim;
– Pay child support;
– Move out of the marital home;
– Attend a batterer’s intervention program;
– Refrain from harming companion animals;
– Provide the victim with identification documents (i.e. birth certificate, Social Security Card); and
– Exercise limited parenting time with the children.
