Probate & Estate Administration
Copps DiPaola Silverman, PLLC represents clients in all types of estate matters, including small estate (voluntary administration), administration proceedings and probate proceedings.
The duties of the executor/administrator include, generally, the following:
- Filing the probate/administration petition and ancillary forms
- Serving citations or obtaining waiver/consents from all distributes (legal next of kin)
- Providing notice to all others named in the Will
- Once Letters are issued by the Court, obtaining an EIN for the Estate
- Opening an Estate bank account
- Gathering the assets of the Estate
- Paying the debts of the Estate
- Filing tax returns for the decedent, filing fiduciary returns, filing gift tax returns, and filing estate tax returns (if necessary in a given case)
- Distributing the remaining funds to the distributees/beneficiaries
- Accounting to the court and beneficiaries/distributees (unless waived by the beneficiaries/distributees)
- Calculating their own statutory commission if they are planning to take a commission
